The Sheriff: More Power Than the President

For many years, the people=E2=80=99s attention in the Battle for = America has been=20 directed toward the federal government and its offices. Candidates stand = for the=20 House and the Senate. Patriotic groups publish voting records of = incumbents.=20 Considerable time, effort and money are expended in support of = candidates for=20 President. After decades of such commendable activity, the record shows = it is an=20 utter failure. The danger to the nation is worse than it ever was.

For many of those years, Republicrud bosses whined that if the people = would=20 only give them control of the federal government, they would undo = Democrud=20 damage and restore Free Enterprise. Finally, the people gave it to them. = Remember? The Republicruds controlled the House, the Senate and the Oval = Office=20 long enough to turn the country around. What happened? The Republicruds = made our=20 problems much worse. Their spending made the profligate drunken sailor = look like=20 Scrooge. They deserved it when the people kicked them out. They lost all = credibility.

Yes, there is Dr. Ron Paul. But Dr. No is a political aberration. = Time and=20 again, he stands alone. He has neither men=E2=80=99s room problems nor = woman problems.=20 He doesn=E2=80=99t take congressional retirement. He actually returns = =E2=80=9Cmoney=E2=80=9D (computer=20 entries) to the federal treasury. He proposes abolishing the Fed and the = income=20 tax and replacing them with nothing. In foreign affairs he suggests that = we mind=20 our own business. Imagine! But, again, he is an aberration.

Why? Certainly one reason has to be that we ship the successful = congressional=20 candidate off to the District of Corruption. However good the new = congressman=20 may have been when he or she boarded the plane to the District; he is = subjected=20 to intoxicating blandishments when he arrives in the enemy camp.

Soon, he succumbs to the blandishments, maybe even making himself=20 blackmailable, and begins to vote as the party boss says, without even = reading=20 the bills. Instead of representing the people of his congressional = district in=20 the District of Criminals, he represents the D.C. to the C.D. He or she = now is=20 one of the boys or the girls. It has happened hundreds of times.

So, if the long, heroic effort to elect federal legislators has = failed, does=20 there remain any governmental Horatius who can stand in the gap; who can = lead=20 the Battle for America and restore the Constitution? There is. Lock and = load,=20 mount up and prepare for the return of the sheriff.

My guess is that in the minds of many Americans the sheriff is an = antiquated=20 figure who lives in the movies. In the older movies he is the hero; he = is Gary=20 Cooper in =E2=80=9CHigh Noon,=E2=80=9D awaiting the train that will = bring killer Frank Miller=20 back to town. In the new ones, he is the southern sheriff, even bigger = than=20 Rosie O=E2=80=99Donnell, sneering, sadistic, racist, violent, etc. He = has no modern=20 relevance.

But now here comes Sheriff Richard Mack, elected and re-elected in = Graham=20 County, Arizona, where he served for eight years. During his tenure, = three=20 federal agents came to a meeting of Arizona sheriffs and told them in = certain=20 terms how they would be dragooned as unpaid federal bureaucrats and = administer=20 the new, federal Brady gun registration law.

The law was named of course for Ronald Reagan=E2=80=99s press = secretary, who was=20 severely wounded in the immensely suspicious attempt to assassinate the=20 President. Since then, Mrs. Brady has become a leader of the campaign = for Nazi=20 gun confiscation. I don=E2=80=99t know whether she was as crazy before = the shootings as=20 she is now. Just one more increment of lunacy and they would have to = lock her=20 up.

Richard Mack and the other Arizona sheriffs at the meeting rebelled. = Sheriff=20 Richard says the language he heard =E2=80=93 in which he did not = participate =E2=80=93 could not=20 be repeated in the presence of genteel Christian ladies, so we = can=E2=80=99t tell you=20 here what the sheriffs said. But Sheriff Mack did take the government to = court.=20 He sued the United States, and Sheriff Jay Printz of Montana joined him = as=20 plaintiff.

On June 27th, 1997, the sheriffs won; in Printz v. U.S. (521 U.S. = 898) the=20 U.S. Supreme Court struck Brady down. Associate Justice Antonin Scalia = wrote the=20 ruling for the Court, in which he explained our system of government at = length.=20 The justly revered system of checks and balances is the key:

=E2=80=9C. . . The great innovation of this design was that = =E2=80=98our citizens would have=20 two political capacities, one state and one federal, each protected from = incursion by the other=E2=80=99=E2=80=9D =E2=80=93 =E2=80=9Ca legal = system unprecedented in form and design,=20 establishing two orders of government, each with its own direct = relationship,=20 its own privity, its own set of mutual rights and obligations to the = people who=20 sustain it and are governed by it.=E2=80=9D (P. 920)

Scalia quotes President James Madison, =E2=80=9Cfather=E2=80=9D of = the Constitution: =E2=80=9C[T]he=20 local or municipal authorities form distinct and independent portions of = the=20 supremacy, no more subject, within their respective spheres, to the = general=20 authority than the general authority is subject to them, within its own = sphere.=E2=80=9D=20 The Federalist, No. 39 at 245.

Again and again, Justice Scalia pounds the point home (page 921): = =E2=80=9CThis=20 separation of the two spheres is one of the Constitution=E2=80=99s = structural=20 protections of liberty: =E2=80=98Just as the separation and independence = of the=20 coordinate branches of the Federal Government serve to prevent the = accumulation=20 of excessive power in any one branch, a healthy balance of power between = the=20 States and the Federal Government will reduce the risk of tyranny and = abuse from=20 either front.=E2=80=99. . .=E2=80=9D Gregory, 501 U.S. at 458.

He quotes President Madison again: =E2=80=9CIn the compound republic = of America, the=20 power surrendered by the people is first divided between two distinct=20 governments, and then the portion allotted to each subdivided among = distinct and=20 separate departments. Hence a double security arises to the rights of = the=20 people. The different governments will control each other, at the same = time that=20 each will be controlled by itself.=E2=80=9D (P. 922)

No one could make this any clearer. The primary purpose of the = Fathers was to=20 prevent someone from grabbing all the power. When that happens, they = knew, the=20 result is arbitrary, confiscatory, government, the kind Tom Jefferson = described=20 in the Declaration of Independence. We would call it totalitarian.

Madison explains: =E2=80=9CThe accumulation of all powers, = legislative, executive,=20 and judiciary, in the same hands, whether of one, a few, or many, and = whether=20 hereditary, self-appointed, or elective, may justly be pronounced the = very=20 definition of tyranny.=E2=80=9D Federalist No. 48, February 1, 1788. =

To prevent=20 that from happening, they divided the power. First, they divided the = federal=20 power into three parts: the executive, the legislative and the judicial. = They=20 would bicker among themselves, so that no one of them could seize all = the power=20 the Constitution grants to the federal government.

The Founders divided the power even more. They set the limited power = the=20 Constitution grants the =E2=80=9Cgeneral authority,=E2=80=9D = Madison=E2=80=99s term for the federal=20 government, against the vast residual powers of the states. Each sphere = of=20 government, state and federal, would be supreme in its own sphere. = Neither could=20 control the other. Each protects itself from intervention by the other. = Each has=20 its own laws and rules.

Madison says this: =E2=80=9CBesides the advantage of being armed, = which the Americans=20 possess over the people of almost every other nation, the existence of=20 subordinate governments, to which the people are attached and by which = the=20 militia officers are appointed, forms a barrier against the enterprises = of=20 ambition, more insurmountable than any which a simple government of any = form can=20 admit of.=E2=80=9D Loc. Cit.

What does all this mean today in the Battle for America? Sheriff Mack = says it=20 proves that the sheriff is the highest governmental authority in his = county.=20 Within that jurisdiction =E2=80=93 inside his county =E2=80=93 the = sheriff has more power than=20 the governor of his state. Indeed, the sheriff has more power in his = county than=20 the President of the United States. In his county, he can overrule the = President=20 and kick his people out. Remember, the President has few and limited=20 powers. 

What? The sheriff can do that? He=E2=80=99s not just a character in a = movie? That=E2=80=99s=20 right. Not only can the sheriff do that; sheriffs have already done = that, more=20 than once. Most Americans are not aware of that because lying, = conspiracy=20 scumbags like Rush Humbug, Shallow Sean Hannitwerp and Hugh Blewitt (a = lawyer)=20 etc., haven=E2=80=99t told them.

Remember, the office of sheriff has a pedigree so long, we are not = positive=20 about when it was created. We think it was in the Ninth Century in = England. We=20 do know that each land district, or =E2=80=9Cshire,=E2=80=9D was = governed by a =E2=80=9Creeve.=E2=80=9D The=20 sheriff of Nottingham became famous. At first, the king appointed them. = With few=20 exceptions, our American shire reeves are elected by the people.

In 1997, in Nye County, Nevada, federal agents arrived to seize = cattle that=20 belonged to rancher Wayne Hage. The sheriff gave them a choice: = skedaddle or be=20 arrested. They skedaddled. The cows stayed where they were. Wyoming = sheriffs=20 have told federal agencies they must check with the respective sheriff = before=20 they serve any papers, make any arrests or confiscate any property.

In Idaho, a 74-year-old rancher shot an endangered gray wolf which = had killed=20 one of his calves. The U.S. Fish and Wildlife Service sent three armed = agents to=20 serve a warrant. Lemhi County Sheriff Brett Barslou said that was=20 =E2=80=9Cinappropriate, heavy-handed and dangerously close to excessive = force.=E2=80=9D More=20 than 500 people turned out for a rally in the small towns of Challis and = Salmon=20 to support the sheriff and the rancher and to tell the federal = government to=20 back off.

While Richard Mack was sheriff of Graham County, Arizona, a bridge = washed=20 out. Parents had to drive twenty six miles to get their kids to school = half a=20 mile across the river. But the U.S. Army Corps of Engineers = wouldn=E2=80=99t fix it.=20 First they had to do an =E2=80=9Cenvironmental impact study,=E2=80=9D to = replace a bridge=20 already there. They were in no hurry. The study would take a mere ten = years.=20

The people=E2=80=99s suffering reached the board of supervisors. The = board voted to=20 dredge the river and fix the bridge. The feds warned that they would be = fined=20 $50,000 per day if they tried. The supervisors hesitated. Sheriff Mack = promised=20 them and the workers protection and pledged to call out a posse for the = purpose=20 if necessary. They built the bridge and the Corps of Engineers faded. = The board=20 never paid a dime.

So the long dormant spirit of America is reviving. The states are = beginning=20 to adopt Tenth Amendment resolutions, using powers they have always had. = The=20 people are restoring our long unbalanced constitutional system. There is = something =E2=80=9Cblowin=E2=80=99 in the wind,=E2=80=9D but it = isn=E2=80=99t what Bob Dylan thought it was.=20 Recently, Sheriff Mack addressed 570 people in Fredericksburg, Texas. He = reports=20 that the reception was =E2=80=9Cbeyond fantastic.=E2=80=9D

What can you do? For once we are not just complaining. There is a = plan. I do=20 not argue that you should forget about Congress. Not at all; if you see = an=20 opportunity there, take it. Always remember that right now it is run by = people=20 like Barney the Bugger of Taxachusetts, who will be elected by moronth = in hith=20 dithtrict until he dieth of AIDS.

Most of the time, when you approach your congressman, you come to = complain.=20 In the new crusade, you will approach your sheriff and tell him that he = is not=20 only handsome, charming and overwhelmingly masculine, but also that he = has=20 powers he may not be aware of. You have come to tell him what they are = and to=20 back him up. My guess is, when you tell him that, he will not kick you = out.

Tell him you expect him to return the courtesy when the Nazis come = from the=20 District of Criminals to get the guns. Tell him you are ready in a = minute to=20 serve under his direction in a posse. He will not move to Washington and = be=20 corrupted. He will stay there with you. Show him the ten orders the Oath = Keepers=20 will not obey. The Oath Keepers are retired and active duty military and = police.=20 Their web site is oath-keepers.blogspot.com. The first order they = promise to=20 disobey is an order to disarm you.

Put him together with Sheriff Mack. You will find him at = sheriffmack.com. His=20 telephone numbers are 928 792-4340 and 928 792-3888. Bring the sheriff = to your=20 town to speak. He will explain all this. Invite your own sheriff. At the = meeting=20 I attended, the local sheriff and chief of police were there and loved = what they=20 heard. No one dislikes hearing how important he is.

What if your sheriff is stupid or a federal factotum? That is what = you will=20 find in many big cities. I once interviewed Los Angeles County Sheriff = Peter=20 Pitchess, who said no one should have a hand gun. I asked him how a five = foot=20 lady alone in bed could defend herself from a rapist. Realizing he was=20 perilously close to making himself look even dumber than he did usually, = Pitchess conceded she could have a long gun.

I brightened. A street sweeper isn=E2=80=99t really the best weapon = for close=20 quarters, but it would give the lady a chance. Unfortunately, Pitchess = added the=20 word, =E2=80=9Cunloaded.=E2=80=9D I asked him what that five foot lady = with an unloaded shotgun=20 could do against a six foot rapist. A police captain sat beside Pitchess = during=20 the interview. His job was to extricate Peter from the jams he persisted = on=20 getting himself into. The police captain extruded a barrage of miasma. = It was=20 effective. I did not get an answer.

In such cases, says Sheriff Mack, move to a county where the sheriff = is=20 receptive. Many more will be. For instance, in Texas there are 254 = counties.=20 Each has a sheriff. If it is feasible to do so, run for sheriff = yourself. Even=20 your wife will be impressed when she sees you with a hog leg on your hip = and a=20 star on your vest. Imagine the intense joy of meeting IRS Communists or = BATFE=20 Nazis at the county line and denying them admission.

The Battle for America will be decided in your county at your front = door. If=20 you act now, later you will not need to =E2=80=9Cfill your = hand.=E2=80=9D

Good argument for gun ownership. Another good argument I never hear = is - what=20 about Brinks and other similar armoured trucks? They drive around every=20 community in America and are armed and are ready to defend cash (not = human life)=20 with deadly force.

Why should they be allowed to defend cash and we not be able to = defend our=20 lives?

Let me remind Sheriff Peter Pitchess that any Marxist ideology, = oppressive=20 tendencies he may have can only be expressed in the privacy of his home, = while=20 out of uniform. Any and all utterances and actions he demonstrates while = on=20 duty, in uniform, must be within the boundaries of the United States=20 Constitution, and his oath of office. Expressing his Marxist ideas and = ideology=20 would be a clear violation of his oath of office, and subject him to = firing.=20
